In BRUNELLI´S, S.L. we continue to work on privacy in the treatment of your personal data, updating our Privacy Policy to inform you about the way we collect, use and store all the data of the people who contact us by any means, according to the following sections:

I.- DATA CONTROLLER.

That the interested party (user) who provides BRUNELLI’S, S.L. with personal data through social networks or online platforms is informed that the party responsible for the processing of the personal data provided will be: BRUNELLI’S, S.L., with C.I.F. B-76651645, and address at calle Pérez de Rozas, 13, piso 5º, derecha, 38003 – Santa Cruz de Tenerife, Spain. Telephone 639.210.029 and e-mail info@brunellis.com.

As the data controller, BRUNELLI’S, S.L. will expressly request the user’s consent to this privacy policy.

In case of any doubt about data protection, the user may contact BRUNELLI’S, S.L. and will be promptly attended.

II.- PURPOSES OF DATA PROCESSING.

Depending on the reason for which the User has contacted us, BRUNELLI’S, S.L. will process the data provided for the following purposes:

– Manage purchases and requests made by the User through our web pages.

– Contacting the User to deal with their requests, requests or queries.

– To provide the User by any means, preferably by sending commercial communications to the e-mail addresses provided by the User, of services, promotions, news and products managed by BRUNELLI’S, S.L.”.

– Manage and control the client portfolio, attend to service requests and proceed with invoicing and collection.

– To carry out promotional activities, including the sending of commercial communications to the e-mail address provided by the User from companies collaborating with BRUNELLI’S, S.L. dedicated to research, teaching and nature protection.

– Involve the User in promotional activities such as games, contests and sweepstakes conducted through our website.

– Where appropriate, to create a user profile, which allows a better relationship between BRUNELLI’S, S.L. and the user, thus optimising possible offers related to our products and services.

– Obtaining curricula vitae, for the purpose of personnel selection.

III.- DURATION OF DATA PROCESSING. TIME OF CONSERVATION OF YOUR PERSONAL DATA.

The User’s personal data will be stored by BRUNELLI’S, S.L. for the legally permitted period of time according to the reason for which the data was provided to us by the User.

The data obtained for promotional activities will be stored for a period of two years, unless the User expressly revokes this in advance.

For the purposes of invoicing and collection of services, where appropriate, the data will be kept for the duration of the contractual relationship, plus the retention period required by applicable legislation and until the statute of limitations for claiming hypothetical contractual liabilities BRUNELLI’S, S.L.” has elapsed.

The data obtained for the management of enquiries and applications will be stored for a maximum period of one year.

The data obtained on the occasion of participation in promotional activities, such as games, raffles and competitions, will be kept for the duration of the said activities for the purposes of their effective development according to the bases of participation and until the consummation of the effects of the User’s participation in the same.

The data provided for the purposes of communication and commercial profiles will be stored by BRUNELLI’S, S.L. will not be used for a maximum period of time, unless the User expressly declares that he/she wishes the data to be deleted.

Data relating to curriculum vitae, during the selection process, and one more year.

IV.- WHAT IS THE LEGITIMACY FOR THE PROCESSING OF YOUR PERSONAL DATA?

The personal data provided by the User are ultimately intended to enable BRUNELLI’S, S.L. to provide the services offered and accepted by you, as well as to enable BRUNELLI’S, S.L. to continue to achieve its legitimate right to grow as a founding company by building customer loyalty and offering new services and products.

V.- WHO CAN HAVE ACCESS TO YOUR PERSONAL DATA?

Personal data may be transferred to companies that collaborate with BRUNELLI’S, S.L., for the aforementioned purposes, upon the User’s express request and subsequent authorisation.

BRUNELLI’S, S.L. may transfer or communicate personal data in order to fulfil its obligations to the Public Administrations when, in compliance with current legislation, it is formally required to do so. It shall do the same when required to do so by the State security forces and judicial bodies in the exercise of their powers.

VI.- WHAT RIGHTS DO YOU HAVE AS A USER?

All Users shall be entitled to exercise their rights of access, rectification, opposition, deletion, portability and limitation of the processing of their personal data.

These rights consist of:

Access, to all the data we have about the user.

Rectification of the data we already have, taking into account that by providing us with the data, the user guarantees that they are true and accurate and undertakes to notify us of any change or modification of the same. Any loss or damage caused to the Platform or the person responsible for the Platform or any third party by reason of the communication of erroneous, inaccurate or incomplete information in the registration forms shall be the sole responsibility of the user.

Deletion of the user’s data as long as they are not necessary for the purpose of the processing or when the user’s consent or permission is no longer required.

Limitation of the processing of user data. You may ask us to temporarily stop processing the data or to keep it for a longer period of time for when he or she may need it.

Opposition to the processing of user data, which may be exercised in the following cases: (i) where the data are processed on the basis of a public interest mission or legitimate interest, including profiling. (ii) where the processing is for direct marketing purposes, including profiling.

Similarly, the User may refuse the automated processing of personal data collected by BRUNELLI’S, S.L.”.

Users’ rights may be asserted through the means of contact listed in section “I” of this Privacy Policy.

If you do not agree with the treatment that BRUNELLI’S, S.L.” gives to the User in the exercise of their rights, you can complain to the Spanish Data Protection Agency and to any other competent supervisory body.

The User may exercise the aforementioned rights or revoke the consent for processing given to BRUNELLI’S, S.L. or request any clarification by sending an express request to the e-mail address gdpr@loroparque.com, proving that he/she is the owner of the data for which he/she wishes to exercise his/her rights.

VII.- THIRD PARTY DATA

Should personal data be obtained from third parties other than the User, they shall be informed in advance of the content of art. 14 of the General Data Protection Regulation.

VIII- FROM WHAT AGE CAN THE USER ACCESS OUR PRODUCTS AND SERVICES?

As a general rule and in accordance with Article 8 of the new General Data Protection Regulation, where Article 6(1)(a) applies in relation to the direct offer of information society services to children, the processing of a child’s personal data shall be considered lawful when the child is at least 16 years old. If the child is under 16 years of age, such treatment shall only be considered lawful if, and only to the extent that, consent was given or authorised by the holder of parental authority or guardianship over the child.

IX.- SECURITY MEASURES IMPLEMENTED.

BRUNELLI’S, S.L., committed to the legally established obligations regarding personal data, has adopted and will adopt all the necessary control measures to try to prevent the data provided by users from being altered and/or suffering unauthorised access or processing. For this purpose, BRUNELLI’S, S.L. maintains the technical and organisational security measures in place to guarantee the security of the User’s personal data in accordance with the applicable regulations.
